ARTICLE 5

OBLIGATIONS AND RIGHTS OF PARTY A

  1. Party A has the following obligations:

- Deliver the apartment mentioned in Article 1 of this Contract to Party B at the time of: ………………………………………………;

- Ensuring Party B's stable use of the rented apartment during the lease term;

2. Bên A có các quyền sau đây:

+ Do not pay the rent for three consecutive months or more without good reason;

+ Using the apartment for improper purposes;           

+ Making the apartment seriously damaged;

+ Repair, exchange or sublease the whole or part of the rented apartment to another without the consent of Party A;

+ Causing public disorder many times and seriously affecting the normal activities of those around them;

+ Making serious impacts on environmental sanitation;

- Renovate and upgrade the apartment for rent with the consent of Party B, but not to cause trouble for Party B;

- Get back the apartment when the lease term.

ARTICLE 6

OBLIGATIONS AND RIGHTS OF PARTIES

  1. Party B has the following obligations:

- Use the apartment for the agreed purpose;

- Pay the rent in full, according to the agreed method;

- Maintain the apartment, repair the damage caused by them;

- Respect rules of public activities;

- Return the apartment to Party A after the lease expires.

2. Party B has the following rights:

- Receive the apartment as agreed;

- To sublet the leased apartment, if Party A agrees in writing;

- Continue to rent under the conditions agreed with Party A, in case of changing the owner of the apartment;

- Priority to sign a continuation lease contract, if the rental term expires but the apartment is still used for lease;

- Request Party A to repair the apartment being leased in case the apartment is seriously damaged;

- Unilaterally suspend the performance of the apartment lease contract but must notify Party A one month in advance and claim damages if Party A commits any of the following acts:

+ Do not repair the apartment when the quality of the apartment is seriously reduced;

+ Increasing unreasonable rent rates;

 + The right to use the apartment is restricted for the benefit of a third person.

THE 7TH RULE

PAYMENT LIABILITY

The fee for renting an apartment under this Contract is borne by the party ………………. responsible for submitting.

ARTICLE 8

ARGUMENT SETLLEMENT

In the course of implementing this Agreement, if a dispute arises, the parties negotiate and settle it on the principle of respecting the interests of each other; In case of non-negotiation, either party may initiate a lawsuit to request a competent court to settle it according to the provisions of law.

ARTICLE 9

COMMITMENTS OF THE PARTIES

Party A and Party B are responsible before the law for the following guarantees:

  1. Party A reassures

1.1. The information about the identity and apartment stated in this Contract is true;

1.2. At the time of signing this Contract:

a) The apartment has no dispute;

b) The apartment is not distrained to ensure judgment execution;

1.3. The conclusion of this Agreement is completely voluntary, not deceived, not coerced;

1.4. Strictly and correctly complying with the agreements stated in this Contract.

2. Party B guarantees

2.1. The personal information stated in this Agreement is true;

2.2. Have carefully considered and known about the apartment mentioned in Article 1 of this Contract and papers on ownership of the apartment and land use right;

2.3. The conclusion of this Agreement is completely voluntary, not deceived, not coerced;

2.4. Strictly and correctly complying with the agreements stated in this Contract.

Article 6: Rights and obligations of Party A

Party A's rights

6.1. Receive the full deposit and apartment rental from Party B (as stipulated in Article 5) on time. Prior to (05) the first day of the next payment period that Party B has not paid, Party A has the right to unilaterally terminate the contract.

6.2. Request Party B to repair and compensate for damage caused by Party B's mistakes to the apartment for rent (if any).

6.3. Check the apartment within the contract term, but must let Party B know the time to check the apartment.

Obligations of Party A

6.4. Hand over the apartment and equipment for rent, electricity and water meter of the apartment for rent on the agreed date.

6.5. Commit that Party A has the legal ownership and rental right to the rental apartment and at the same time ensure that the rental apartment is free of disputes.

6.6. Ensure the complete and separate use of Party B for the apartment for rent throughout the term of the contract and is responsible for ensuring the rights of Party B under this contract even when transferring ownership rights to with apartments for rent. In addition, in that case, Party A has the obligation to ensure that the new owner will replace Party A and receive all the rights and obligations of Party A formed from this lease during the ownership period. for rent.

6.7. Refund the deposit to Party B when the apartment lease terminates if Party B does not violate any terms under this contract and after deducting the debt of service cost of Party B (according to the 4.3 Article 4).

The 7th rule: Rights and obligations of Party B

Party B's rights

7.1. Have the full right to use the above apartment for the purposes mentioned in Article 2.

7.2. Get back the deposit amount when the apartment rental contract terminates if Party B does not unilaterally break the contract. Party B will receive this amount after Party A has deducted the debt of Party B's service costs, as well as the cost of compensation for loss and damage to the apartment and equipment caused by Party B out (if any) during the lease term.

Obligations of Party B

7.3. Use the apartment for the right purpose. When needing to repair or renovate according to specific use needs, it must be approved by Party A. Do not repair without permission of the lessor.

7.4. Responsible for his personal belongings and apartments. Minor damages in the apartment such as: fire of the electric bulb, sanitary switches, broken glass ... Party B is responsible for promptly notifying the apartment management board to hire the repairer, at the expense paid by Party B, as well as the cost of compensation for damage and equipment damage to the apartment (furnished by the Owner from the beginning) caused by Party B if any during the lease term.

7.5. Guaranteed civil rights, not wanted or serving sentence.

7.6. Strictly complying with regulations on environmental sanitation and general security order and safety of fire prevention and fighting in the building. Do not use flammable substances, materials, explosives or other hazards affecting the area around the residence. Implement the regulations of the Building Management Board.

7.7. Do not transfer the lease, or sublease it, or use it for any other purpose.

7.8. Directly pay rent to Party A. Full payment of electricity, water, service charges ... (in Section 4.3, Article 4) on time as prescribed by the Management Board and the State.

7.9. At the end of the contract, the house must be delivered to Party A in a condition commensurate with the use time (accept normal wear and tear due to the use time and wear due to natural conditions). If Party B causes damage to the apartment, then Party B must compensate the corresponding cost for Party A.

Article 8:  Termination of contract

8.1. The termination of an apartment lease without compensation is made in the following cases:

  • The contract expires under Article 3 of this contract.
  • The apartment was demolished under a decision of a competent authority.
  • Due to other force majeure circumstances including but not limited to natural disasters, fires, wars ... leading to Party B can not continue to stay at the above apartment.
  • The two sides agree to terminate this contract ahead of time.

8.2. During the contract performance, if Party A unilaterally terminates the contract ahead of time, Party A must notify Party B at least 30 days in advance and return Party B to the amount of Party B's deposit and compensation. Usually the same amount of deposit to Party B.

8.3. During the contract performance, if Party B unilaterally terminates the contract ahead of time, Party B must notify Party A at least 30 days in advance and Party B will not be returned a deposit by Party A. Party B is responsible for paying the cost of using the service (as stated in Clause 4.3, Article 4) as well as the cost of compensation for damages and loss of the apartment and equipment if caused by it.

8.4. One (01) month before the contract expires, Party B notifies Party A in writing or by telephone of the contract termination. If Party B wants to continue to rent, the two sides will discuss the extension of the contract and the rent. Party B will be given priority for extension.

8.5. Before the end of the contract, Party B is responsible for paying all costs (stated in Section 4.3, Article 4).

8.6. Party A or Party B has the right to unilaterally terminate the contract, and not have to compensate the other party, in case the other party violates the contract terms.

Article 9: General Terms              

9.1. Fully comply with the terms above.

9.2. In case of dispute, both parties must discuss to find a solution. If agreement cannot be found, it will be brought to civil court.

9.3. The content of this contract has been well understood. The two parties agree to all terms of this Agreement and voluntarily sign.

9.4. The minutes of equipment handover are an integral part of this Agreement.

The contract is made into 02 (two) copies, each copy has 04 contents with the same content and legal value, each party keeps 01 (one) copy. The contract takes effect from the signing date.
